This website is operated by PROPER STREETWEAR (“we”, “us”, “our”), operated by PROPER ONLINE PTY LTD. We provide this website and all related information, content, features, tools, products and services (together, the “Services”) to you, subject to these Terms of Service (“Terms”) and any policies referenced in them.
By accessing, browsing, or purchasing from our Services, you agree to be bound by these Terms, as well as our Privacy Policy, Returns Policy, and Shipping Policy. If you do not agree, you must not access or use our Services.
Our store is hosted on Shopify Inc. Shopify provides the e-commerce platform that enables us to sell our products and Services to you.
We may update these Terms from time to time by posting changes on this page. Continued use of the Services constitutes acceptance of any updates.
1. ELIGIBILITY AND ACCESS
By using the Services, you confirm that you are at least the age of majority in your place of residence, or you have permission from a parent or guardian.

We reserve the right to refuse service, suspend access, or cancel orders where permitted by law.

You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. Accounts must not be transferred, sold, or assigned.

We reserve the right to limit quantities, restrict sales by region, modify descriptions or pricing, or discontinue products at any time, where permitted by law.
4. PRICES AND PAYMENT
All prices are subject to change without notice. Prices are shown in the currency displayed at checkout.
You authorise us to charge your selected payment method for your order total, including shipping and applicable taxes.
We may cancel or refuse orders where fraud, misuse, or unauthorised activity is suspected.
5. ORDERS AND CANCELLATIONS
Placing an order constitutes an offer to purchase. Orders are not accepted until confirmed and/or dispatched.
Change-of-mind cancellations are not guaranteed once an order has been processed.
All refunds, returns, and exchanges are governed by our Returns Policy.
6. PRE-ORDERS (NO CANCELLATIONS)
Some items may be sold as Pre-Orders. These items are not yet in stock and will be dispatched at a later date.
All Pre-Orders are final and cannot be cancelled, changed, or refunded once placed, including changes to size, colour, or address.
Dispatch dates are estimates only and may change due to production or freight delays.
Once dispatched, Pre-Orders are handled in accordance with our Returns Policy, unless otherwise stated.
7. SHIPPING AND DELIVERY
All delivery timeframes are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control.
Risk of loss passes to you once the order is handed to the carrier, to the extent permitted by law.

8. PROMOTIONS AND DISCOUNTS
Promotions and discount codes are subject to additional terms disclosed at the time of issue. Promotions may be modified or withdrawn at any time.
Discounts cannot be applied retrospectively unless stated otherwise.

We are not responsible for third-party websites or services linked through our Services. Accessing third-party content is at your own risk.
10. INTELLECTUAL PROPERTY
All content on the Services is owned by or licensed to PROPER STREETWEAR and protected by intellectual property laws.

13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, PROPER STREETWEAR and its related parties will not be liable for indirect or consequential loss, loss of profits, data, or goodwill.
Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
14. INDEMNITY
You agree to indemnify and hold harmless PROPER STREETWEAR and its related parties from claims arising from your breach of these Terms or misuse of the Services.
15. GOVERNING LAW
These Terms are governed by the laws of the Commonwealth of Australia and New South Wales. You submit to the non-exclusive jurisdiction of NSW courts.
